Man, 28, defiles girl 15, says it happened in the sitting room not bathroom

Defilement is any sexual intercourse with a child under the age of 16 years old, whether or not the child consents 160girls.org

This is the ordeal of a 15-year-old girl in Labone, Accra when a 28-year-old man who, Gyamfi had carnal knowledge of her after two unsuccessful attempts.

This was revealed by the Persecution when Gyamfi was arranged before a Circuit Court in Accra, charged with defilement.

What did Gyemfi Do? Defilement 

According to the story as published by ghanaweb.com , Gyamfi followed the victim to the bathhouse while she was going to urinate.

Whiles her underwear was at knee level to respond to natures call, the alleged culprit ordered the girl bend down on a stool and later had an affair with her from behind.

He later instructed her to report that she was raped by an unknown man.

During the hearing of the case, Gyamfi told the court that, the act did not take place in the bathroom but in his sitting room.  

The attempt to disprove the spot of the incidence is funny and immaterial if it is established by the court that he committed the crime.

The complainant is the sister of the victim and sister-in law to Gyamfi the alleged perpetrator of the crime.

According to the criminal offences act – 1960 (act 29) section 101 clause 1 and 2 which borders on defilement of a child under 16 years of age defilement is the natural or unnatural carnal knowledge of any child under sixteen years of age.

Whoever naturally or unnaturally carnally knows any child under sixteen years of age, whether with or without his or her consent commits an offence and shall be liable on summary conviction to imprisonment for a term of not less than seven years and not more than twenty-five years.
